Land Court win concerning easement dispute

Most questions in the law have answers, but once in a while you come across a "question of first impression." Massachusetts has not decided whether an easement on a registered land parcel can be terminated by way of estoppel. So over the summer, Moscone Law moved to dismiss a clam on behalf of one of my clients. 

 

Moscone Law argued, among other things, that this is a significant policy question that will have implications far beyond the parties in this lawsuit. After written submissions and oral argument, Moscone Law was able to persuade a Justice of the Land Court that an easement on registered land should not be terminated by way of estoppel.
